Service Terms and Conditions

These Terms and Conditions apply to Truth Ebikes (booked under Truth Travel) tours and rentals. In these Terms and Conditions, references to "you" and "your" and “participant” include the first-named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred. By making a booking, the first-named person on the booking agrees on behalf of all persons detailed on the booking that:
• he/she is over 18 years of age and, when placing an order for services with age restrictions, declares that he/she and all members of the party are of the appropriate age to purchase those services;
• he/she has read these Terms and Conditions and has the authority to and does agree to be bound by them;
• he/she accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

All bookings made with Truth Ebikes are made subject to the following Terms and Conditions.
1. Payment details
To secure a booking, the Truth Explorer E-bike Rental Terms and Conditions Form needs to be completed, signed, and the required payment made to Truth Ebikes. Once you have completed the form and confirmation of the payment has been received by Truth, a binding agreement comes into place between you and Truth. The onus rests on you to ensure that all the information on the Truth E-bike Rental Terms and Conditions Form is correct.

2. Pricing
Prices on the Truth website are expressed in South African Rands. There is no price adjustment offered for arriving late or departing early from a booking. We reserve the right to correct errors in the prices of confirmed bookings.

3. Client Cancellation and Changes
Should you wish to change your booking date, your request has to be submitted in writing more than 24 hours before the date of your booking. Requests to change the date of an existing reservation will be accommodated based on availability. If you are prevented from fulfilling the booking, the booking may be transferred, provided that the transferee complies with all the conditions applicable to the tour and agrees to the terms and conditions and all other terms set out in this agreement. Notification of such changes must be submitted in writing.

If you are unable to find a replacement and wish to cancel a confirmed booking for reasons other than hospitalisation or death, the following terms govern the refunding of confirmed bookings:
• Less than 48hrs before scheduled booking = No refund
• Less than 72hrs before scheduled booking = 50% refund
• More than 72hrs before scheduled booking = 100% refund
• All bookings cancelled by TRUTH EXPLORER due to a force majeure or any other reason beyond the control of
Truth will be refunded in full.
Notification of a cancellation must be submitted in writing. and will take effect from the date at which it is received at Truth. No refunds will be given for unused services.

4. Receipt and Delivery of E-bike
To enact the rental, you need to submit your ID or passport to a representative of Truth Explorer. Upon receipt of the e-bike, the onus rests on you to inspect the e-bike for pre-existing defects. If you report no defects at the time of receipt of the e-bike, the e-bike will be deemed in good working order and condition. Upon return of the e-bike, Truth shall inspect the e-bike and if not in the same condition in which it was collected by you, Truth may charge you for damage or loss incurred during the rental period, as determined by Truth with a quotation in respect of the cost of repairs. Should you fail to return the e-bike within the stipulated time frame, you will incur additional fees. Your ID or passport will be returned to you once the e-bike has been returned and all costs and additional fees that may have arisen due to your actions during the rental period, have been settled in full.

5. Client Responsibilities
You acknowledge that the risks posed by the use of an e-bike are beyond the control of Truth and agree to accept all risks associated with riding the e-bike, including bodily injury or death. You agree that Truth is not liable for any accidents, injuries, or loss of personal belongings. You agree that you are responsible for your own safety and agree to at all times abide by applicable road rules and traffic laws.
You agree to keep the e-bike in your possession and take all the necessary steps to protect the e-bike against theft, loss, or any damage. You accept liability for any theft, loss, or damage to the e-bike and its accessories, and any expenses incurred in retrieving the e-bike and accessories. You may not allow anyone to use the Truth e-bike without prior permission from Truth. You may not use the Truth e-bike for any race events or contests, and use it only on normal roads and gravel surfaces.
The e-bike is not insured, and you are fully responsible for the replacement of a new e-bike in the case of theft or failure on your part to return the e-bike.

6. Notices and Domicilia
You choose as your domicillia citandi et executandi for the giving of any notice, the serving of any legal process for any purpose arising out of this agreement, at your address and email address as set forth in this agreement.

7. Jurisdiction
This agreement is governed by and interpreted in accordance with the laws of the Republic of South Africa, and the parties consent to dispute resolution in a magistrates' court of competent jurisdiction in South Africa.
