
CANCELLATION POLICY
Cancellation by Truth Kayaking
Truth Kayaking (“the Company”) reserves the right to cancel any hiking tour due to circumstances beyond its control. This includes, but is not limited to, unsafe weather conditions, wildfire risk, trail closures, safety concerns, or any other emergency that may affect the scheduled hike.
Weather-Dependent Tours
Hiking tours are subject to weather and trail conditions. In the event of a cancellation due to weather or safety considerations, the Company will make reasonable efforts to:
Notify guests of the cancellation at least one (1) hour before the scheduled start time. In cases of sudden weather or environmental changes, this notification may occur within one (1) hour of the scheduled start.
Offer guests an alternative hike date or route, subject to availability.
If rescheduling is not possible, a full refund will be issued.
Rescheduling by Guests
Guests wishing to cancel or reschedule their booking must do so no later than 24 hours before the scheduled hike. Any rescheduling request made after this period will not be accepted.
Cancellations must be made via email or WhatsApp and will be considered effective once Truth Kayaking confirms receipt of the communication.
Refund Policy
For cancellations made more than 24 hours before the scheduled hike, guests are entitled to a full refund or a voucher for the equivalent amount.
No refund will be issued for cancellations made less than 24 hours before the scheduled hike.
TERMS AND CONDITIONS OF SERVICE
By booking a hiking tour with Truth Kayaking, the guest (“the Participant”) acknowledges and agrees to the following terms and conditions:
1. Arrival and Punctuality
Participants are required to arrive at least 10 minutes before the scheduled start time of the hike. Truth Kayaking will make reasonable efforts to accommodate late arrivals, but cannot guarantee participation if the group has already departed.
2. Indemnity and Check-in
All participants must sign an indemnity form and/or check-in online before the start of the tour. Failure to do so will result in exclusion from the hike, with no refund issued.
3. Guidance and Compliance
The lead hiking guide will provide a safety briefing at the start of the tour. Participants must follow all instructions and stay within sight of the guide at all times.
Deviating from the prescribed route or ignoring guide instructions may result in removal from the group for safety reasons.
4. Minors on Tours
Any person under the age of 18 years is considered a minor.
Minors must be accompanied by an adult who is responsible for their safety and conduct throughout the hike.
The minimum recommended age for a minor to participate in a hiking tour is 10 years old, depending on the difficulty and duration of the chosen route.
5. Responsibility for Minors
Adults accompanying minors are jointly and severally responsible for the supervision, wellbeing, and behaviour of the minors in their care.
By booking a hike that includes minors, the adult accepts these terms on behalf of the minor(s), including all assumptions of risk.
6. Liability for Damages
Participants shall be liable for any damage to equipment (such as trekking poles, headlamps, or other gear) resulting from negligence, failure to follow instructions, or inappropriate behaviour.
7. Adherence to Safety Instructions
Participants must adhere to all safety instructions provided by the guide, who has full discretion to make decisions regarding safety, route changes, or early termination of the hike in response to conditions on the trail.
8. Health and Fitness Responsibility
Each participant is solely responsible for assessing their own physical fitness and health condition before joining a hike.
Participants are encouraged to disclose any medical conditions (such as asthma, vertigo, or previous injuries) to the guide before the start of the hike.
Hiking involves natural risks including uneven terrain, exposure to the elements, and potential encounters with wildlife. By participating, guests acknowledge and accept these inherent risks.
PRIVACY POLICY AND DATA PROTECTION
Truth Kayaking is committed to safeguarding your personal information in accordance with the Promotion of Access to Information Act 2 of 2000 (PAIA).

PAYMENT METHODS
Accepted Payment Methods
Payments for bookings may be made via Visa, MasterCard, or other credit cards. For direct bookings, payments may be made via bank transfer or cash to Truth Kayaking’s designated account. Bank details will be provided upon request.
Credit Card Transactions
All credit card transactions are processed via PayGenius (Pty) Ltd, a secure and accredited payment gateway.
PayGenius uses SSL3 encryption technology to ensure the highest level of security. No credit card details are stored on the Truth Kayaking website.

Currency and Merchant Information
The merchant outlet country is South Africa, and the transaction currency is South African Rand (ZAR).
GENERAL TERMS
Responsibility for Transactions
Truth Kayaking assumes full responsibility for all aspects of the transaction, including the sale of services, customer support, and dispute resolution.
Domicilium Citandi et Executandi
Truth Kayaking’s domicilium citandi et executandi (address for service of legal notices) is located in South Africa.
All communications and notices will be sent to the registered address or email provided by the customer.
Variation of Terms
Truth Kayaking reserves the right to amend or update these terms and conditions at its discretion, without prior notice. Such amendments will take effect immediately upon publication on the website.
Applicable Law
These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.
